Flight Compensation Regulations — Quick Overview

This section provides a clear overview of the main passenger rights regulations worldwide. Compensation availability, amounts, and conditions depend on the applicable legal framework, route, airline, and circumstances of the disruption.

Regulations with Fixed Monetary Compensation

European Union — EU Regulation 261/2004 (EU261)

Fixed compensation:

  • €250 — flights up to 1,500 km

  • €400 — intra-EU flights over 1,500 km and other flights 1,500–3,500 km

  • €600 — flights over 3,500 km

Applies when:

  • Delay at final destination exceeds 3 hours

  • Flight is cancelled with less than 14 days’ notice

  • Denied boarding due to overbooking

Conditions:

  • Disruption caused by airline-controlled reasons

  • No extraordinary circumstances

Applies to:

  • All flights departing from the EU

  • Flights to the EU operated by EU airlines

United Kingdom — UK261

Fixed compensation:

  • £220 / £350 / £520–£600 (distance-based)

Same structure as EU261, applied after Brexit.

Applies to:

  • Flights departing from the UK

  • Flights to the UK operated by UK or EU airlines

Canada — Air Passenger Protection Regulations (APPR)

Fixed compensation (arrival delay):

  • 400 CAD — 3–6 hours

  • 700 CAD — 6–9 hours

  • 1,000 CAD — 9+ hours

Conditions:

  • Airline is responsible for the delay

  • Applies mainly to large airlines

Applies to:

  • Flights departing from Canada

  • Flights to Canada operated by Canadian carriers

Turkey — SHY-PASSENGER

Fixed compensation:

  • Equivalent of €100–€600 (distance-based)

Critical condition:

  • Applies only to flights departing from Turkey

Does NOT apply to:

  • Turkish Airlines flights departing outside Turkey

Israel — Aviation Services Law

Fixed compensation:

  • Amounts set in Israeli shekels (ILS), distance-based and indexed

Compensation amounts are set in Israeli shekels (ILS) and are linked to the Consumer Price Index. Approximate base amounts:

  • ₪1,320 — flights up to 2,000 km

  • ₪2,120 — flights 2,000–4,500 km

  • ₪3,180 — flights over 4,500 km

(Exact amounts may slightly vary due to indexation.)

Applies when:

  • Long delays

  • Flight cancellations

  • Denied boarding

Applies to:

  • Flights departing from Israel

  • Flights to Israel operated by Israeli airlines

Regulations Without Fixed Compensation

United States — US DOT Rules

No compensation for delays or cancellations.

Compensation applies ONLY for:

  • Denied boarding due to overbooking

Amount:

  • Up to 400% of the one-way ticket price

  • Maximum approx. USD 1,550

Applies to:

  • Flights departing from or within the United States

Brazil — ANAC Resolution 400

No fixed monetary compensation.

Passengers are entitled to:

  • Assistance (meals, accommodation, communication)

  • Refund or rerouting

  • Reimbursement of documented expenses

Applies to:

  • Flights departing from Brazil

  • Domestic and international flights operated by Brazilian carriers

Serbia — National Law & Montreal Convention

No fixed compensation.

Claims are assessed under:

  • Montreal Convention (Article 19)

  • National consumer protection principles

Compensation depends on:

  • Proven financial or non-material damage

Saudi Arabia — GACA Passenger Rights

No guaranteed fixed compensation.

Rights mainly include:

  • Care and assistance

  • Refund or rebooking

  • Possible compensation for documented losses

Applies to:

  • Flights departing from Saudi Arabia

  • Saudi-licensed carriers

International Flights — Montreal Convention (1999), Article 19

Global framework for delay-related damage.

Compensation:

  • No fixed amount

  • Up to 5,346 SDR (Special Drawing Rights)

Covers:

  • Missed business meetings

  • Lost working days

  • Additional accommodation and transport

  • Stress and physical exhaustion (where legally recognized)

Applies when:

  • No regional fixed-compensation law applies

  • Delay caused by airline’s failure to take reasonable measures
